“The sharing of these poles between telecommunications providers and the energy distributor is essential to make small providers viable, which correspond to around 52% of the Brazilian broadband market. With Poste Legal, we will facilitate the expansion of services based on equal and transparent management of access to poles, with cost-based remuneration”, highlighted Juscelino Filho.

By regulating the occupation of poles, it will be possible to ensure that cables and equipment are properly installed and organized, avoiding any risk to the population and minimizing visual impact. The policy will also encourage digital inclusion, as connectivity in remote areas is one of the Federal Government's priorities.

“This is a long-awaited action to meet the population’s demand, in such a strategic and important sector for the country. Sharing poles will not only bring cleaning to large cities, but also sustainability and more efficiency. It is President Lula's government united to make public policies for Brazilians”, stated minister Alexandre Silveira.

Electricity companies may charge for occupying the poles. The value must be based on the costs involved, avoiding any form of cross-subsidization between sectors. In this way, it will be possible to promote a fair relationship between those involved, even generating a reduction in operational costs for energy, internet and telephone companies, which can result in reduced costs for the Brazilian consumer.

All Poste Legal guidelines will be reflected in a joint regulation by the National Telecommunications Agency (Anatel) and the National Electric Energy Agency (Aneel). The local authorities will define the methodology and rules for defining the amounts to be paid for sharing poles, as well as the rules and definition of responsibilities for regulating occupations, monitoring and maintaining the use of poles.

HOW IT CURRENTLY WORKS - Joint resolution no. 4, of December 16, 2014, defines rules for sharing poles. The text was prepared by Aneel and Anatel. Each internet, telephone and pay TV provider can install a maximum of one fixing point per pole.

Telecommunications companies directly request sharing from energy distributors. Some electricity companies provide direct channels for interested parties to request the occupation of poles. If the installation is granted, telecommunications providers pass on amounts to the distributor. Each pole has a limit of telephone cables to be installed. This determination guarantees security to the networks, to avoid overloading the structures.
